1. About the Service

Pothole Payback is an AI-powered tool that generates claim letters for pothole damage to vehicles. The service is provided by Roundbear Ltd, Farthing Corner, West Tytherley, Salisbury SP5 1NR, GB.

2. What We Are Not

We are not a solicitor, law firm, or claims management company. We do not provide legal advice. We are a self-service document generation tool that creates letters based on information you provide.

3. Your Responsibilities

  • All information you provide (photos, dates, costs, descriptions) must be accurate and truthful.
  • You are responsible for reviewing the generated letter before sending it to your council.
  • You are responsible for sending the letter and any subsequent correspondence or negotiation.
  • Making a false or exaggerated claim is fraud. We reserve the right to refuse service if we suspect misuse.

4. Eligibility

You must be 18 years of age or older to use this service. By using Pothole Payback, you confirm that you have the legal capacity to make a claim against a highway authority.

5. Payments & Refunds

  • Single claim:£5
  • 3 claims per year:£10

Payments are processed securely by Stripe. As the claim letter is digital content delivered immediately upon payment, refunds are not available once the letter has been generated. This is in accordance with the Consumer Contracts Regulations 2013.

6. No Guarantee of Success

We cannot and do not guarantee that your claim will be successful. The outcome depends on your council's response, the specific circumstances of your case, and the evidence available. Average claim figures cited on the site are illustrative and based on published data — they are not a guarantee of what you will receive.

7. AI-Generated Content

Our photo analysis and letter generation use artificial intelligence. While we strive for accuracy, AI can make mistakes. You should always review the generated letter and correct any inaccuracies before sending it.

8. Intellectual Property

The generated claim letter is yours to use. The Pothole Payback service, branding, and underlying technology remain the property of Roundbear Ltd.

9. Limitation of Liability

To the fullest extent permitted by law, Roundbear Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service or the outcome of any claim you make using our generated letters.

10. Changes to These Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
